The Supreme Court has struck out an appeal filed by the Peoples Democratic Party (PDP) and its presidential candidate in the 2019 election, Atiku Abubakar.
Justice Dattijo Muhammad, leading a five-man panel, dismissed the appeal on Tuesday on grounds of it being statute-barred.
Atiku and the PDP had filed the appeal to challenge a ruling of the Presidential Election Petition Tribunal which held that they failed to file a response to an application by the All Progressives Congress (APC).
The dismissal comes barely 24 hours to the closing of arguments by parties to the petition scheduled for Wednesday.
APC had inter alia prayed the court to dismiss the petition at the tribunal.
