The Court of Appeal in Abuja made a significant decision on Monday, invalidating the election of Senator Elisha Abbo, who represented Adamawa North district.
In their ruling, a panel of five judges declared Amos Yohanna, the candidate of the Peoples Democratic Party, as the rightful winner of the senatorial election.
This verdict follows a prior ruling in August by the same Court of Appeal in Abuja, where Senator Abbo was ordered to pay N50 million in damages for assaulting a woman named Osimibibra Warmate in a s*x toy shop in Abuja on May 11, 2019.
Abbo had pursued the case at the Appeal Court after Justice Samira Bature of a High Court in the Federal Capital Territory (FCT) initially ruled against him on September 29, 2020.
A three-member panel of the appellate court, led by Justice Jamilu Tukur, dismissed Abbo’s appeal.
The court rejected Abbo’s argument that Ms Warmate’s claim that he slapped her, pulled her hair and dragged her out of the shop did not amount to rights violation, but a case of simple assault.
It also rejected Abbo’s argument that the suit was not properly conducted at the trial court and that he was denied a fair hearing.
