INEC Not Mandated To Collate Or Transmit Results Electronically - Tribunal

 

The 2023 Presidential Election Petition Tribunal PEPT has dismissed the second issue of non-transmission of result sheets to IReV.

The court which is presently delivering judgment on the petition by the Labour Party candidate, Peter Obi against the victory of the All Progressives Congress APC candidate, President Bola Ahmed Tinubu, held that there is no law that says INEC must mandatorily transfer or transmit the results of the election from the polling units electronically.

 

It says the law empowers INEC to decide the means of collation of the results of elections in Nigeria.

 

The presidential court said the non upload of results to the viewing portal of Nigerian’s electoral umpire as relied upon by labour party to disqualify the election is not a solid ground as the portal was just for merely giving the public another opportunity to see the election results

 

The court believes the main collation of election result is the hard copy except where there is no hard copy then the electronic one will be relied upon
