Senator Bamidele Helped Obi To Defeat Tinubu In Court

 

In court yesterday, Peter Obi’s lawyer asked Tinubu’s witness whether the drug money forfeiture that Tinubu made to the US government to the amount of about $460K was civil or criminal in nature.

The witness, ”Sinator” Bamidele (elected the previous day as the senate majority leader and a self-acclaimed legal practitioner in the US) replied that it was civil in nature.

Then the lawyer asked him whether he knows the section of the US law in which the forfeiture was based.

The witness replied with a strong yes and went ahead to quote the section. The section he quoted is called 18 U.S.C. § 982.

Obi’s lawyers agreed and the judges took notice.

Now, it happened that forfeitures made under 18 U.S.C. § 982 are criminal in nature. They are in fact called CRIMINAL FORFEITURES. So, Tinubu’s own witness just nailed his master on the cross.

18 U.S.C. § 982 states

(1)

The court, in imposing sentence on a person convicted of an offense in violation of section 1956, 1957, or 1960 of this title, shall order that the person forfeit to the United States any property, real or personal, involved in such offense, or any property traceable to such property.

Now what does 1956 say? It says:

(1)Whoever, knowing that the property involved in a financial transaction represents the proceeds of some form of unlawful activity, conducts or attempts to conduct such a financial transaction which in fact involves the proceeds of specified unlawful activity—

Now what is unlawful activity? 18 USC § 1956(c)(7)

specified unlawful activity as

(7) the term “specified unlawful activity” means— (A) any act or activity constituting an offense listed in section 1961(1) of this title except an act which is indictable under subchapter II of chapter 53 of title 31; (B) with respect to a financial transaction occurring in whole or in part in the United States involving— (i) the manufacture, importation, sale, or distribution of a controlled substance (as such term is defined for the purposes of the Controlled Substances Act);

Now what is controlled substance?

Obi’s lawyer set a trap for Tinubu’s witness, and he fell into it like an olodo rabata. Now you know why Tinubu called only one witness. The more witness they produce the more they fall into a hole.
