Tinubu 'll Not be Sworn-in If Obi Pushes His Petition; He Doesn’t Need to Wait 180 Days - Agbakoba, SAN

Former President of the Nigeria Bar Association (NBA) Olisa Agbakoba (SAN) says that if Peter Obi pushes his petition, Asiwaju Bola Ahmed Tinubu won’t be sworn in and won’t have to wait the required 180 days. He said this when he was being interview on the Arise TV, monitored by IgbereTV.

Following the conclusion of the 2023 general elections amid lingering concerns that the process was marred by irregularities and the petition filed against the All Progressives Congress (APC) by the Labour Party Candidate, Peter Obi, in an effort to reclaim the mandate it claims was stolen from him, Olisa Agbakoba, a Nigerian human rights activist, recently shared his thoughts on the topic, saying that the 25% requirement is compulsory in the Federal Capital Territory (FCT) before a winner can emerge in a presidential election.

This was revealed by the attorney in an interview with Arise News, who also advised the LP presidential candidate to file an application for summary judgment immediately rather than waiting the full 180 days if he did not want the President-elect to be sworn in on May 29.

Even though there is a 180-day deadline, he can be released even on the first day, he claims. “Nothing stops justice from prevailing. “If Peter Obi is pushing his petition and doesn’t want the president-elect to be sworn in, why does he have to wait for 180 days? If he files a petition, he should submit applications for a summary judgment.

For instance, Kenya has a 30-day window for filing an election petition, but nobody waits until the end of that window. In order to make a pre-entry strike after filing your petition, you should be prepared. If I had submitted a petition on Monday, by Tuesday, I would have submitted all of my paperwork and asked the court to rule on a few jurisdictional issues. I don’t have to wait until the 179th day because I have 180 days to act.
