Judge & FG Lawyers Frustrated By Resilience Of Defense Counsels To Kanu & Co-defendants

The prosecuting counsel representing the Nigeria government, Hon. Barrister S.I Labaran, as well as the judge in charge of the proceedings, Mrs Binta Nyako have expressed discomfort over the continuous applications being filed by the Defense Counsels to IPOB leader, Nnamdi Kanu and co-defendants, seeking for the court to grant their clients bail and to reject a secret trial for the defendants.

Following the introduction of the Counsels, Hon. Barrister Ifeanyi Ejiofor, Counsel to the first defendant-Nnamdi Kanu, requested the court to review its order made on December 13, 2016 against the bail of the defendant and in favour of a secret trial.

“My Lord, we filed an application on the 22/3/2017. In support of this application, is a Nine Paragraph affidavit, by Uchechukwu Moborogwu.
A written address dated 16/3/2017, was also filed,
“We plea that, this honourable court should review the order made on the 13th day of December 2016,” Barrister Ejiofor told the court.

However the Counsel of prosecution, S.I Labaran objected the application saying:

“My Lord, having gone through the application filed, we found out that, it has no difference with the previous one filed,

“We hereby plead that, the court should accept the countered affidavit before the court,
“We also demand that, my Lord should dismiss the application, because it does not just lack merit, but is frivolous in nature and a ploy to delay this matter.We hereby adopt the oral written address and affidavit,” he stated.

The counsel to the Third defendant(Barrister Essene) adopted the argument of the first defense counsel, for the third defendant, and which the prosecuting counsel also objected.

The judge intercepted in favour of the Counsel of Prosecution, and warned the defense counsels against frustrating the trial of the accused:

“This filing of new applications by the defending counsels is delaying this case. I might get angry and adjourn this case, if this continues like this,” the judge stated.
