BREAKING: Court Stops INEC, Senate From Executing Judgement Sacking Ifeanyi Ubah

The Federal High Court sitting in Abuja has restrained the Independent National Electoral Commission (INEC), Clerk of the National Assembly and Clerk of the Senate, from effecting a lower court’s judgment that sacked Ifeanyi Ubah from the Senate.

Justice Taiwo Taiwo gave the interim order on Thursday, stating that parties in the matter should take no further step in executing the judgement of the High Court of the Federal Capital Territory dated April 11, 2019, as well as ruling of the same court dated January 17, 2020, pending the hearing and determination of a motion on notice which Ubah filed before it.

The judge fixed February 6 to hear Ubah’s suit.

Justice Bello Kawu of High Court of the Federal Capital Territory in Kubwa, Abuja had ordered Ubah’s sack for allegedly submitting a forged National Examination Council (NECO) certificate to contest the February 23, 2019, senatorial election.

The judge also ordered INEC to issue a certificate of return to Obinna Uzoh of the Peoples Democratic Party (PDP) who came second at the election.
