The Federal High Court in Abuja has restrained the 2007 presidential candidate of the African Democratic Congress (ADC), Professor Pat Utomi, and any other person acting under his authority from further establishing a shadow government.
The trial Judge, Justice James Omotosho while delivering judgement in matter filed by the Department of State Services, DSS, held that creating a shadow government is unconstitutional, null and void.
The trial judge held that Sections 1(1) and 2 (1) of the 1999 Constitution are supreme and binding on all citizens, as the defendant is not entitled to his right of freedom of expression and association by forming a shadow government.
